Acceptance of Terms

Welcome to AGARMOVE. These Terms of Service (“Terms”) govern your use of our website and services provided under Secure Writer Relocations Pvt. Ltd. By accessing or using our services, you agree to be legally bound by these Terms, our Privacy Policy, and applicable laws in India.

1. Definitions

  • Customer: Any individual or entity availing services
  • Services: Includes packing, moving, storage, transportation, and related services
  • Goods: Items to be transported, excluding prohibited items
  • Fixtures: Items requiring dismantling or installation services
  • Warehouse: Storage facility used for holding goods

2. Scope of Services

Subject to the accepted quotation, services may include:

Relocation Services

  • Pickup of goods from origin
  • Packing and handling
  • Transportation to destination
  • Storage (if required)
  • Basic coordination for documentation (if applicable)

Additional Services (at extra cost)

  • Dismantling and reinstallation of fixtures
  • Specialized handling or custom requirements
  • Third-party or subcontracted services

Vehicle Transportation

  • Valid documents must be provided
  • Cars must contain minimal fuel for loading/unloading
  • Two-wheelers must have empty fuel tanks to avoid leakage

3. Working Hours

Services are generally provided between 9:30 AM to 8:00 PM (Monday to Saturday), excluding public holidays. Services outside these hours may attract additional charges.

4. Quotations & Acceptance

  • Quotations are valid for 15 days unless withdrawn earlier
  • Acceptance occurs upon confirmation or service instruction
  • Pricing is based on details provided by the customer
  • Incorrect or incomplete information may lead to revised charges

5. Cancellation & Changes

  • Cancellation terms are governed as per the agreed quotation
  • Changes in service requirements may result in additional charges
  • Early termination may incur applicable fees

6. Service Execution

The Company reserves the right to determine the method, route, and execution of services, including use of third-party vendors where necessary.

7. Timelines

All timelines provided are estimated. While reasonable efforts are made, delays may occur due to operational or external factors. The Company is not liable for delays beyond its control.

8. Customer Responsibilities

The Customer agrees to:

  • Provide accurate and complete information
  • Ensure proper access to premises
  • Comply with all applicable laws and regulations
  • Avoid including prohibited or hazardous items

Prohibited Items Include:

Cash, jewelry, explosives, chemicals, flammable materials, illegal goods, and other restricted items.

9. Exclusions from Services

Unless specifically included in the quotation, the following may not be covered:

  • Multiple pickups or deliveries
  • Special handling or heavy lifting charges
  • Parking, tolls, union charges, or local taxes
  • Staircase handling beyond standard limits
  • Storage in transit or force majeure situations

10. Payments

  • Payment is required before packing or dispatch unless otherwise agreed
  • Additional costs (taxes, duties, or changes) are payable by the customer
  • Delivery may be withheld until full payment is received

11. Storage Terms

  • Customers may access stored goods during working hours with prior notice
  • Retrieval of goods requires advance notice
  • Storage charges apply as per agreement

12. Liability & Insurance

  • Basic liability is limited and subject to applicable terms
  • Customers are advised to opt for insurance coverage for protection against transit risks
  • The Company is not responsible for:
    • Natural deterioration
    • Improper packing by customer
    • Force majeure events (flood, fire, strikes, etc.)
    • Undeclared or misdeclared goods

13. Claims & Reporting

Domestic Moves

  • Claims must be reported within 2 days of delivery
  • Vehicle-related claims within 12 hours

International Moves

  • Claims must be reported within 15 working days
  • Vehicle-related claims within 24 hours

Failure to report within timelines may result in claim rejection.

14. Insurance Limitations

Insurance does not cover:

  • Government seizure or customs actions
  • Cash, jewelry, documents, or restricted items
  • Internal damages without external signs
  • Owner-packed goods (unless declared and insured separately)

15. Right of Lien

The Company reserves the right to retain goods until all dues are cleared. If unpaid beyond a specified period, goods may be disposed of to recover dues as per applicable law.

16. Website Usage Terms

Permitted Use

You may access the website for personal use only.

Prohibited Actions

You must not:

  • Copy, reproduce, or redistribute content for commercial use
  • Use the website for illegal or harmful activities
  • Upload malicious software or unauthorized data
  • Perform automated data extraction (scraping, mining, etc.)

17. User Content

Any content submitted by users must:

  • Be lawful and non-infringing
  • Not violate third-party rights
  • Not lead to legal disputes

We reserve the right to remove or modify user content.

18. No Warranties

The website and services are provided “as is” without warranties of any kind. We do not guarantee:

  • Continuous availability
  • Accuracy or completeness of information

19. Limitation of Liability

The Company shall not be liable for:

  • Indirect or consequential losses
  • Business losses, revenue loss, or data loss

The Company is not liable for failure or delay due to events beyond control, including natural disasters, strikes, or government actions.

22. Governing Law

These Terms are governed by the Indian Contract Act, 1872, and applicable laws of India. Any disputes shall be subject to the jurisdiction of courts in Mumbai, India.
